PolishLandlord.com and its web app is an internet based real estate platform, and is referred hereinafter as “PolishLandlord.com”, “Polish Landlord Inc.”, “we”, “us”, “our”, “site”, “web service”, “web app”.

Terms and Conditions
PolishLandlord.com is a closed platform for Property Owners in Greenpoint and NYC. PolishLandlord.com is a place for exchange of knowledge and information in the field of general real estate service in NYC. We operate in the form of an Internet service, the purpose of which is to enable Users to ask questions in the form of Q&A and to make posts according to the rules set forth in these Regulations and information made available directly on the Platform.
Regulations
Each User is obligated, from the moment of undertaking activities aimed at using the Platform (by which is also meant the mere browsing of the Platform), to comply with the provisions of the present Regulations.
The User is obliged to read the content of these Regulations. Acceptance of the Regulations is voluntary, but is a condition of use of the Platform.
Terms of use of the Platform
Users arę obliged to use the Platform in a manner consistent with applicable law, the Regulations, the regulations of the sites and the regulations of the Providers, as well as with the principles of social coexistence, including the general rules of use of the Internet and websites, and with respect for the rights of third parties and the Provider. In particular, the User is obliged to use the Platform in a manner that does not interfere with its functioning, does not inconvenience other Users and the Provider, and respects the personal rights of third parties (including the right to privacy) and any other rights to which they are entitled. In addition, the User is obliged to use all information and materials made available through the Platform only within the scope of permitted use.
4 Prohibited content
The User is obliged not to provide content of an unlawful or offensive nature, content that violates the personal rights of third parties, incitement to commit a crime, and vulgar statements, as well as content of an advertising nature without the prior consent of the Service Provider. Users are obliged to immediately notify the Service Provider of any violation of their rights in connection with the use of the Platform.
5 Consequences of violations
If it is determined that the User engages in activities that are prohibited by law or the Terms of Use, or that violate the rules of social conduct or are detrimental to the legitimate interests of the Service Provider, the Service Provider may take any action permitted by law, including restricting or preventing the User from using the Platform and the services provided through it.
On the pages of PolishLandlord.com it is forbidden to post in violation of the letter of federal, state and local laws.
PolishLandlord.com editors are not responsible for the content of posts, nor for any consequences or damages resulting from them.
Posting rules are subject to change without notice or announcement.
By posting any post on PolsihLandlord.com, the user agrees to use his/her e-mail address as contact e-mail for marketing and information purposes, and also agrees to receive:
product-related communications and information from PolishLandlord.com and its affiliates.
The transmission of marketing information may take the form of e-mail messages sent directly by PolishLandlord.com on its own behalf or on behalf of another entity.
The Service Provider, including in cooperation with Providers, may make additional services and content available to Users within the Platform. The principles of providing services electronically within the framework of these services are defined by the individual regulations of these services.
USER ACCOUNT
1. users
The contract in terms of registration of a User Account can be concluded by persons of legal age. The age of majority is determined by the law of the respective country of origin of the User, with a minimum age of 18 years. Provision of the Service Provider also includes enabling browsing of the Platform in parts visible to persons without a User Account.
2 Agreement
The User, when performing any activity on the Platform, hereby declares that he/she has familiarized himself/herself with these Terms and Conditions and the other documents visible or accessible through the Platform, and that he/she accepts their contents fully and without any reservations for an indefinite period of time.
3 User Account
Registration of the User Account shall be performed solely by the User. The User is obliged to provide the required information contained in the registration form on the Platform. The Service Provider is not responsible for the consequences of third parties obtaining the password to access the User Account. A User may have only one User Account on the Platform.
4 Closure of the User's Account
Both the User and the Service Provider have the right to close the User's Account without giving reasons. Termination of the contract shall be understood as closure of the User's Account. The termination of the agreement is effective at the time of the closure of the Account by the User or by the Service Provider. The Service Provider reserves the right to terminate the agreement with immediate effect, in particular in the case of violation of important provisions of these Regulations by the User, which is considered primarily the dissemination of information by the User contrary to these Regulations or the rules of social coexistence.
5 Representations by the User
The User accepts the provisions of these Regulations in their entirety, without reservations or additions, and acknowledges and accepts that the Service Provider does not guarantee the User that the use of the Platform or its functionalities (including available Products) will bring the User the results, outcomes, or economic or financial benefits expected by the User. Furthermore, with respect to all transactions made through the Platform, the Service Provider informs, and the User accepts, that the right of withdrawal is excluded due to the delivery of digital content.
The User further represents that he/she is acting in his/her own name and on his/her own behalf.
USER CONTENT
1 User Content
The Platform allows you to add posts, texts, photos, videos, links and other files and other information, in order to make them available for public reproduction. By User Content, we mean all material that the User submits, publishes or displays to others through the Platform. In view of the foregoing, the User acknowledges and accepts that in the course of using the Platform, this content may be viewed by other third parties. The Service Provider may remove User content suspected of being spam or violating the provisions of these Terms of Service, within the framework of the internal judicial system operating on the Platform.
The Service Provider is not responsible for the content provided by the User. The Service Provider shall exercise due diligence in verifying the content posted by Users, however, the Service Provider cannot guarantee proper authorization for content published on the Platform in terms of content legality, truthfulness, or reliability. Use of the content is at the sole risk of the User.
2) Posting content on the Platform and granting a license
1) By transmitting, publishing or displaying User Content on the Platform, User grants to Service Provider a royalty-free non-exclusive license without territorial limitation in all fields of exploitation, including but not limited to using, copying, reproducing, processing, adapting, modifying, creating derivative works, publishing, transmitting, storing, displaying and distributing, translating, communicating and making available to the public, including in the field of automatic distribution, such as application programming interface (also known as “API”). The User agrees that this license includes the right of the Service Provider to make the User's content available to other third parties, including Providers for the purpose of transmission, communication and public sharing, distribution or publication of the User's content on the Platform.
2) The license set forth herein also includes the right of other Users of the Platform to use, copy, reproduce, adapt, modify, create derivative works, publish, transmit, display and distribute, translate, communicate and make available to the public the User's content. Except as expressly provided in these Terms and Conditions, the license granted by the User does not grant the right to use automated technology to copy, send queries and answers or collect queries and answers for the purpose of creating derivative works.
3) After publishing an answer to a question, a User may edit or remove his/her answer from public view on the Platform, provided that no one has previously added any comment or other answer to the answer or question in question. A published question may be edited or deleted at any time by the User posting the question or by the Service Provider. Any changes made by the User may be visible to other users. The right of the Service Provider to copy, display, transmit, publish, perform, distribute, store, modify and otherwise use any question posted by the User and to sublicense such rights to others is irrevocable to the maximum extent permitted by the provisions of common law, except as separately provided in these Terms and Conditions.
4) The User acknowledges and agrees that the Service Provider may retain the User's content, and may disclose the User's content and related information if required by generally applicable law or for: (a) enforce the Terms and Conditions; (b) respond to claims that User Content posted on the Platform violates the rights of third parties.
5) The User agrees that the Service Provider may modify, adapt or create derivative works from the User's content for the purpose of transmitting, displaying or distributing it over computer networks or other data transmission techniques using telecommunications, information technology and wireless networks on any medium.
6)The User also grants the Service Provider the authority to act as a non-exclusive agent to take action against unauthorized use of the User's content by third parties outside the Platform.
7)The Service Provider may at any time remove or refuse to publish the User's content, in whole or in part.
3 Responsibility of the User
By publishing their content on the Platform, the User represents and warrants that: (a) he/she has ownership rights or has obtained all necessary licenses or permissions to use the content and to grant the Service Provider the right to use the User's content in accordance with the provisions of these Terms and Conditions, and (b) the User's published content does not violate the intellectual property or personal rights of third parties or commonly applicable laws. The User accepts full responsibility for any infringement of intellectual property or personal rights of other third parties or violation of generally applicable laws in connection with the content posted on the Platform. You are responsible for ensuring that the content you post does not violate these Terms and Conditions or any other published rules on the Platform or other applicable laws. The User agrees to bear all license fees, pay royalties and any other monies owed to any person for the User's content.
4 Security.
The User shall protect all passwords, logins and data allowing access to the User's Account from access by third parties. Any consequences arising as a result of third parties coming into possession of passwords, or other data allowing access to the User Account, shall not give rise to any liability on the part of the Service Provider.
COPYRIGHT AND INTELLECTUAL PROPERTY
1 Entity entitled
All rights to the Platform, including intellectual property rights to the Platform, as well as to individual parts of the Platform, in particular to the textual, graphic, multimedia and programming elements generating and operating the Platform, including industrial property rights and any other derivative rights, excluding content provided by Suppliers or Payment Operators, belong to the Service Provider.
2 Use of content on the Platform
Transmission of content on the Platform to third parties is permitted only through the use of tools contained on the Platform and intended for this purpose. The User has no right to reproduce, sell or otherwise market or distribute the source code of the Platform, in whole or in parts, in particular to transmit or make it available in computer systems and networks, mobile application distribution systems or any other ICT systems.
3 License
Upon use of the Platform and acceptance of the Terms of Use by the User, PolishLandlord grants the User a non-exclusive license to use the Platform to the extent that the User uses its Services. The license is non-transferable and is granted for the duration of the User's use of the Platform for its intended purpose and in a manner consistent with these Terms of Use.
The non-exclusive license granted to the User, does not authorize the User to grant further licenses. Furthermore, the User is not authorized to act beyond the scope of the License.
4 Limitations
Transmission to third parties of the content contained on the Platform is permitted only with the use of the tools contained and included on the Platform in the manner intended for this purpose of the Platform. The User is not permitted to reproduce, sell or otherwise market or distribute the source code of the Platform, in whole or in parts, in particular to transmit or make it available on computer systems and networks. If you fail to comply with these restrictions, your use of the Services available through the Platform is prohibited, and PolishLandlord may revoke your license. In addition, the User shall be liable for any violation of the law. Under no circumstances shall the User:
1) violate any generally applicable laws, including intellectual property rights;
2) perform any actions against the community of Platform Users, the PolishLandlord platform and its lawyers, the purpose of the Services, or misuse the Services; including the User may not publish, upload or share any information, photos or videos that may be construed as prohibited content or content that violates good morals or rules of social conduct;
3) modify or interfere with the Services, directly or indirectly, using cheats, exploits, automation software, bots, hacks, mods or other unauthorized third-party software;
4) Harm the Services, computers and servers, or other Users, including but not limited to overloading servers, spreading viruses, gaining unauthorized access to the Services or other data protected by PolishLandlord, especially personal data, manipulating the Services and their rankings, or exploiting bugs in the Services or modifying any files included in the Services without prior written consent from PolishLandlord.
5 Breach of rules
If the User violates the rules of use of the Platform or the terms of the granted license, PolishLandlord will be entitled to block the User's access to the Platform (including termination of the User's Account) and revoke the granted license. In the event of a violation, PolishLandlord may, at its sole discretion, take appropriate action, including, in particular, removing content published on the Platform by the User. The above shall be without prejudice to the Service Provider's right to take other appropriate and legally prescribed actions in connection with the violation.
